Terms and Conditions

The Service is a software tool that helps water well and pump contractors capture field inspection data, generate professional inspection reports, and share those reports with customers, realtors, and other invited parties. The Service is a working tool — it is not permanent document storage and it is not a permanent archive.

The Service is not intended to be, and must not be relied upon as, a permanent records storage system, archive, or system of record. You must not rely on the web app as your only copy of any report, photo, or data.

We do not guarantee that any report, photo, portal link, deficiency, file, message, or other data will remain available for any specific period of time. Reports, photos, portal links, and data may become unavailable, corrupted, deleted, overwritten, lost, inaccessible, or removed at any time, with or without notice.

You are solely responsible for saving, downloading, printing, exporting, and backing up your inspection reports, photos, and related data. You should download and save a final PDF copy of each report you need to keep, and you should print or store backups outside of the Service. Portal access is a convenience only; shared report links may expire or stop working at any time.

Inspection reports generated by the Service are based on the information that you and your inspectors enter into the Service. The Service does not independently verify any of that information. Reports reflect your professional judgment as a licensed inspector or contractor, not ours.

Reports generated using the Service are not warranties, guarantees, engineering certifications, water quality certifications, code compliance certifications, environmental certifications, legal advice, title advice, or escrow advice. The Service does not perform laboratory testing, engineering analysis, or regulatory certification of any kind.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate registration information and to notify us promptly of any unauthorized use of your account.

The Service allows you to share reports through secure portal links with realtors, customers, buyers, sellers, and other invited parties. Shared report links may expire or stop working. Recipients may download, print, save, forward, screenshot, or otherwise preserve the reports. We are not responsible for what recipients do with reports after access is granted.

You retain ownership of the inspection data, photos, and reports you create using the Service ("User Content"). You grant us a limited license to host, store, process, transmit, and display your User Content solely to operate and improve the Service. You represent that you have all rights necessary to upload your User Content and to share it through the Service.

You agree not to use the Service to:

• violate any law or regulation;
• infringe the rights of any third party;
• upload malicious code, attempt to breach security, or interfere with other users;
• misrepresent inspections, falsify reports, or impersonate another inspector or company; or
• use the Service as a system of record where regulations require independent permanent storage.

Some features of the Service may require a paid subscription. If your subscription lapses, is cancelled, or your account becomes inactive, your access to reports, photos, and data through the Service may be suspended, limited, or terminated. You are responsible for downloading and backing up any data you need before that happens.

We may change, suspend, or discontinue any part of the Service at any time, including features, storage, portal links, and report formats. We may also discontinue the Service entirely. We do not guarantee that data will remain available after any such change or discontinuation.

The Service may rely on third-party providers for hosting, email delivery, payment processing, mapping, storage, and other functions. We are not responsible for third-party service failures, outages, or data loss caused by those providers.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT REPORTS, PHOTOS, OR DATA WILL REMAIN AVAILABLE OR RECOVERABLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL [INSERT LEGAL COMPANY NAME] OR ITS OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. THIS INCLUDES, WITHOUT LIMITATION, LIABILITY FOR LOST REPORTS, UNAVAILABLE REPORTS, BROKEN PORTAL LINKS, LOST REAL ESTATE TRANSACTIONS, MISSED DEADLINES, FAILED CLOSINGS, BUSINESS INTERRUPTION, LOST DATA, AND THIRD-PARTY SERVICE FAILURES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
